7 Jan. 1875; Upshur County, W. Va., 19 June 1882. 

Dau. SARAH MARIAN SHREVE, grandchildren BENJAMIN F. H. 
SHREVE and MARIAN H. SHREVE. Friends Allen Fenimore and Harris 
Cox, grandson Benjamin F. H. Shreve, exs. 

Testator desires pmt. of debts and funeral expenses; be- 
queaths estate to exs. and their survivors for use of testa- 
tor's dau. SARAH MARIAN SHREVE during her life and equal divi- 
sion for her children BENJAMIN F. H. SHREVE and MARIAN H. 
SHREVE upon her death; exs. are to sell realty and collect 
money, investing proceeds in bonds and mortgage on real estate, 
interest accruing thereon to sd. SARAH MARIAN and at her death, 
principal and interest equally to sd. BENJAMIN F. H. and MARIAN 
H.; in case either sd. BENJAMIN F. H. or MARIAN H. die without 
issue, then property to survivor; if litigation involving tes- 
tator's land in French Creek, Upshur County, W. Va., not be 
settled prior to probate of will, then exs. to carry on prose- 
cution of suit and if sd. property is recovered, exs. to sell 
same and give deeds therefor; proceeds of sd. sale, after pmt. 
of costs, to sd. dau. SARAH MARIAN SHREVE; under no circum- 
stances is son-in-law Benjamin F. Shreve to have any part of 
estate and any moneys pd. to sd. SARAH MARIAN are to be in her 
control.

Testator has, since making will, purchased large tract of 
land in Webster and Nicholas Counties, W. Va., and has claims 
in several other counties; places sd. property "in the same 
position as directed in the will and subject to all the limit- 
ations as set forth in sd. will and giving a devisee the same 
accordingly."
