I Ila Lake of Marion County and State of Virginia being of sound and disposing mind, do make this to be my last will and testament in manner and form following that is to say, I desire my body to be buried at the direction of my Executors here in after named and I direct that all my just debts be paid out of my estate as soon after my death as may be convenient. First, I bequeath to my wife Sally all my lands that I now owen to her her lifetime and all my farming utensils and all my house hold furniture. I also leave to Ann Tucker her maintainance her lifetime out of my lands - and I leave to her four head of sheep. I have heretofor give to my son George one horse and saddle and one cow and two head of sheep. I also have give to my son Gibson one horse and I allow for him to have one saddle and one cow and two sheep. And I also have give to my son John one horse and I allow fo him to have one saddle one cow and two head of sheep and I have also give to my son William one horse and I allow him one saddle and one cow two head of sheep. Now after my decease I do not wish or allow any appraisement to be made of my personal property. I only desire and wish them I leave it to divide it among their selves. Lastly I do hereby constitute my sons George Lake and Gibson Lake Executors of this my last will and testament. In witness whereof I the said Ila Lake have set my hand and seal this 19th of April 1862. Ila Lake Signed sealed published and declared by the testator Ila Lake as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto superscribed our names as witnesses. Witness Samuel Linn Thomas G. Lake. West Virginia SS: At a Circuit Court held for the County of Marion on the 12th day of April 1864: The last will and testament of Ila Lake deceased was on this day produced in Court and Thomas G. Lake, Samuel Linn, John Lake, George Lake, Gibson Lake and William Lake who had been summonded as persons interested in the probate of said will appeared in presuance of said summons, and it being proved by the evidence of Sam- uel Linn and Thomas G. Lake subsvribing witnesses to said will that the said Ila Lake at the time of his death was a resident of this county, that he was of sound and disposing mind and memory, and that the said will was signed in the presence of said witnesses who were present at the same time and who subscribed the said will in the presence of the testator. It is ordered that the said will be admit- ted to probate. And George Lake and Gibson Lake the persons named in said will as Executors thereof appeared in Court and refused to qualify as such.
