First, I give to my children William Hughs, Evaline Lowe, Josiah Hughs, Thomas Hughs, and the children of my son John Hughs (deceased) all my estate all my estate boath real and personal (John Hughs children takeing the share of their father) to be equally divided amongst them at my deceased with the exceptions hereinafter named. Secondly, I give to my wife Nancy for use during her natural life the land reserved in the deed of conveyance to my son James for her use during life, her natural life, together with the beds & bedding and the rest of my household fur- nature together with two cows to hold for her use dureing her life. Thirdly, I give to my grand son Jacob Hughs the son of John Hughs my surveying instruments at my death. Lastly, I appoint my sone William Hughs my Executor to carry into effect his my last will, and it is further my wife that the front of my estate here left to my daughter Eleanor Lowe shall be vested in Thomas S. Haymond whose dute it shall be to take possession of the real estate as well as the personal estate that shall be allotted to my said dau- ghter Eleanor, and rent the said lands for the benefit of my said daughter Eleanor, and pay the rents to her annually as well as the interest of the money allotted to her out of my personal estate so long as her husband Cephis Lowe shall live and at his death to give up to the said Eleanor if liveing and if not here to her children the said lan- ded estate and money. Meredith Virginia Sct: At a Circuit Superior Court of Law and Chancery held in and for Marion County on Satur- day the 15th day of April in the year one Thousand eight- hundred and forty eight. A proper writing purporting to be the will of Thomas Hughs was this day presented for probate by William Hughs the executor named therein; and Harriet A. Hay- mond and William Haymond subscribeing witnesses, were sworn and examined, and the hand writing of Thomas Meredith, the other subscribeing witness who was shown to be out of the commonwealth, was duly proved, and the testemoney being heared the court is of opinion that the said will paper writing is fully proved boath as to the lands and personally to be the last will and testament of the said Thomas Hughs deceased, and the same is ordered to be recorded as such, and thereupon on the motion of the said William M. Hughs the executor therein named, who made oath thereto, and together with Thomas A. Little, William Swearrangen, William Mandell, and Pinck- ney B. Arnett his security, were qualified as to their sufficiency entered into and acknowledged, their bond in the penalty of four thousand dollars, conditioned as the law directs certifi- cate is granted him for obtaining a probate of the said will in due form.
