Wagner, Lynch Mine, was helping blacksmith shoe a vicious mule in a pair of stocks; mule kicked scantling loose from end of stocks, which struck Wagner above the left temple, crushing his skull. Mike Lulitz, Gypsy Mine, had loaded his car and was waiting for the driver to take it out when the slate began to fall on the left side of the room. He began backing out from the face to get away and fell and was caught by the falling slate. The place was well timbered, and roof apparently in good condition. Fenton, Erie Mine, was going out of mine when he met a driver with a trip of loads. He stepped aside and when he did so he stepped on the wrong side of the track and was caught between car and rib. Gazar Toth, Pinnickinnick Mine, was loading a mine car when he was caught by a fall of head coal that he had undermined but not shot down. Head coal was loose and being mined and open at one end, the weight caused it to fall from roof. He should have picked or shot the coal down before loading the car. Aug. 19, 1904; died Sept. 12, 1904. D. W. Cattrill was assistant mine foreman at the Fall Run Mine, and was making his rounds. He went into a room where two men were working and found a piece of loose draw slate which seemed dangerous. He instructed the men to take the slate down before doing any mining, and started to go out of the room, but instead of walking around this loose slate he went directly under it and had only taken a few steps when it fell upon him, breaking his back and right leg, from which injuries he died at the Miners' Hospital, Fairmont, Sept. 12th. Gabriel Strapface, Lynch Mine, was assisting to put car of slate on track. A small piece of slate fell and he jumped forward near the car when a large mass of stone fell and caught him. John Mitchell, Interstate Mine, was operating puncher machine, cutting a crosscut. He had made one cut and was about to finish the last one when a piece of slate fell, striking him on the back. He said the place looked safe, but as a precaution he should have sounded it. He died at the Miners' Hospital, Fairmont. Additional information for from page 147. Joseph Palata, Perry No. 3 Mine, had fired a shot and went back immediately and commenced loading a car. He did not wait a sufficient length of time for the smoke to clear out of this working place. In making this shot the timber within 10 feet of the face was knocked down by the force of the shot, leaving a large piece of overhead slate and coal without any support. He took no notice of this but went to work and had only been working a few minutes when the slate fell. Additional information for Joseph Palata from page 147. Hill, Ocean Mine, was employed as helper on ma- chine. They had made two cuts and were working on the third when the coal which had been undercut fell. Tony Julious, Phoenix Mine, had been working on the 1st right heading when the mine was closed down indefi- nitely for repairs. Owing to the mine's being idle the fan had not been running for several days and orders were that no one was to enter the mine until the fan was started. This man had his tools in the mine and without consuling anyone went in after them. This 1st right heading was generating some gas which he fired at the last crosscut. He was so badly burned that he died several days later at the Miners' Hospital. Additional information for Tony Julious from page 147.
