Crawford Esq'r Secretary of the War Department City of Washington Submitted to the War Department MHC --------------------------------------------------------------------------- State of Vermont, Rutland County} I Samuel Witherell of Shoreham am in the county of Addison and State of Vermont Depose and say that I was born in Hanover, in the State of Massachusetts in the year 1762 that in Sept'r 1817 I was fifty five years old that in the month of January or February in the year 1781 I Enlisted as *** in the Continental Service under Capt Bannister a M* Woodbint Lieut who commanded the Company as Cap't Bannister was mostly at Springfield Doing the Duty of Muster M**ter in March 1781 I joined the army at West Point under Col'o Shepherd and General Pattersons Brigade Col'o Shepherd was after wards appointed a Brigadier Gen'l and Col'o Millen Commanded the Regiment which was called the fourth Regiment of the Massachusetts line and in the Last Part of my service Col'o Jackson Commanded said Regiment in October 1781 I was taken Prisoner and carried into New York and Detained a Prisoner Eight months and two days and then exchanged and again join'd my Regiment I remained In the service without ever having a furlough or returning home at any time until the 31st December 1783 when I was honorably discharged from service by Major General Knox in the State of New York am now Destitute of any kind of Property Either Real or Personal except a very small share of clothing and a very small share of household furniture and Poor and indigent and in reduced Circumstances and stand in great want & need of assistance from my country for support and further this Deponant Saith not my discharge I request to be enclosed and herewith transmitted that I have no other evidence now in my power of my said services Sam'l Witherell to *** Di** and Subscribed Sworn before me at Orwell in the County of Rutland and and State of Vermont this first Day of April 1818 Pliny Smith, Chief Judge of Rutland County Court I hereby Certify that I am Personally acquainted with the above named Samuel Witherell that he Lives in an adjoining town and but two and a half miles from my residence in Orwell that the facts as above stated and Sworn are Sufficiently Prov'd to my satisfaction by the oath of the said Samuel and I believe he is Poor and Destitute of Property either Real or Personal as he has represented and in Poor and indigent Circumstances and in real want of assistance and I further Certify that on this Day he has Shown & Presented to me his P***** Discharge from the army in the following words and b**** to wit --- By the honourable Major General Knox Commanding the American forces on Hudson's River Samuel Witherell soldier in the fourth Massachusetts Regiment being enlisted for three years is hereby honorably Discharged from the service of the United States -- Given in the State of New York the thirty-first Day of December 1782 By the General Command Knox M. Temple Clk --------------------------------------------------------------------------- Sam'l Witherell Shoreham 7208 ***** 19 C Sep 1819 --------------------------------------------------------------------------- STATE OF VERMONT County of Addison, ss. -- On this 12th day of June 1820, per- sonally appeared in open Court, being a Court of record (having the power of fine and imprisonment) for the said County Samuel Witherell, aged 57 years, resident in Shoreham in said County, who being first duly sworn according to law, doth on his oath declare that he served in the Revolutionary war as follows: -- from March 1781 for three years, under an enlistment for that period, in the 4th Massachusetts regiment, commanded by Col. Shepard in Capt Bannister's Company that the date of his original declaration is the first day of April 1818, the number of his pension certificate is 7208/ And I do solemnly swear that I was a resident citizen of the United States, on the 18th day of March, 1818; and that I have not, since that time, by gift sale or in any manner, disposed of my property, or any part thereof with intent thereby so to diminish it, as to bring myself within the provisions of an act of Congress, entitled "An act to provide for certain persons engaged in the land and naval service of the United States in the Revolutionary war," passed on the 18th day of March, 1818; and that I have not, nor has any person in trust for me, any property or securities, contracts or debts due to me, nor have I any income other than what is contained in the schedule hereto annexed, and by me subscribed. -- 5 Sheep & 3 lambs purchased with pension money $6.00 1 hog $2.00 1 knife & fork .12 1 axe .75 3 Bucher knives .50 1 hoe .20 1 Shovel & tongs .75 1 Scythe .75 4 Iron spoons .17 1 case of drawers 2.50 2 Cider barrells .67 3 Common dining chairs 1.50 2 Meat barrels .75 1 Rocking chair .75 1 Wooden pail .25 1 maple table .75 ======= 1 pot" cracked .50 9.31 1 Dish kettle-cracked .34 1 Spider - cracked .34 his 1 Tea kettle - cracked .25 Sam'l Wetherell 2 Pewter plates .50 mark 2 milk pans 1 teapot .30 ====== 11.68 --------------------------------------------------------------------------- And the said declarant, on his oath aforesaid further states, that he is by occupation a farmer; that his health has been good, & he has been able to labour until last fall - while endeavoring to pry up a rock, he slipped & fell about 11 feet on to a rock, & thence among the rocks four & five feet, & was so bruised & injured, that he was a long time confined to the house & has never since been able to perform any labour, and he has reason to think, he shall never recover from the effect of that injury, that he has in his family, depending upon him for support, two children - Calvin aged 18 years, who for eight years has been deranged & insane & has thereby occassioned this declarant constant care & expense, & has never been able to take care of himself, & Rachael 7 years, which he has to have boarded at considerable expense. That by means of the sickness & distress of his family, he has unavoidably contracted debts to a considerable amount, which he has found no means, by his best efforts to discharge, & he now owes to Hon. Charles Rich about -- 60. Davis Rich about 10. Doct. Blin, for medicine and, a large sum, but how much he is not able to state. Sworn to & declared the 12th day of June 1820, before the court aforesaid. Sam'l Swift Clerk I, SAMUEL SWIFT, Clerk of the County Court for the County of Addison in the State of Vermont, do hereby certify that the foregoing oath and the schedule thereto annexed are tru- ly copied from the record of the said Court; and I do further certify that it is the opinion of the said Court, that the total amount in value of the property, exhibited in the aforesaid schedule is Twenty Dollars and 99 Cents.
