A. ========================================================================== Pages 41 - 45 WALTER TIMMERMAN date of death: 31 December 1886 date of will: 13 November 1886 date of probate: 18 February 1887 spouse: None petitioner: Isaac Ives -------------------------------------------------------------------------- Last Will and Testament of WALTER TIMMERMAN, deceased Memorandum of agreement Entered into between WALTER TIMMERMAN of the Township of Custer, County of Mason, and State of Michigan and ISAAC IVES of the Township, County and State afore- said. Witnesseth, that the party of the first part, agrees to lease or rent for a period of two years, from and after the date of this instrument, the following described parcel of Land, known and described as the N. E. 1/4 of N. W. 1/4, Section 18, 18-16., containing 40 acres, to the party of the second part for and upon the following considerations, - The party of the Second part to clear and fence ten acres of the above described property, within the time specified above. And it is further provided that upon the death of the party of the first part (if it Should occur within the time above noted,) the party of the Second part on virtue of the agree- ment is to become the owner of the above mentioned property, that is to Say the N. E. 1/4 of the N. W. 1/4, Sec. 18, 18-16. The party of the first part reserves 10 acres of timber on the South E. corner of the above named property. W. 1/4 Sec. 18, 18-16, Mr. TIMMERMAN requested the introduction of a clause providing that the Property in case of his death Should become the property of Mr. IVES.
