WILL OF GILCHRIST OVERTON Dated September 19, 1860 Recorded Nov. 5, 1860 Georgia Greene County In the name of God Amen I GILCHRIST OVERTON, being of advanced age and knowing that I must shortly depart this life deem it right and proper both as respect my family and my self that I should make a disposition of the property with which a kind Providence has blessed me, to thereby make this my last Will and Testament. Item 1st – It is my will and desire that after my death that any just debts be paid. Item 2nd – I do give UNTO MY WIFE AMANDA my watch, buggy and buggy horse (Buck) and the sum of two Thousand Dollars, which property I give and bequeath unto her and it is given in lieu and in full extinguishment of her whole right of Dower in my real estate. Item 3rd – I give TO MY INFANT DAUGHTER ELIZA Two Thousand Dollars. Item 4th – I give TO MY GRAND CHILDREN SARAH A RICHARDS AND JOHN S. FLYNT Five hundred Dollars each. Item 5th – I wish my beds, bedstands and bed clothes to be divided equally BETWEEN MY WIFE AMANDA, MY DAUGHTER SUSAN F. BROOKE, MY GRAND DAUGHTER SARAH A. RICHARDS, MY SON WILLIAM A. OVERTON, MY DAUGHTER MARTHA A. THORNTON AND MY DAUGHTER HARRIET A. RICHARDS. Item 6th – I will that my negroes be divided into seven equal shares and given to the following persons their heirs and assigns, to wit, my wife Amanda to receive one share my infant daughter Eliza one share my daughter Susan one share, my grand children Sarah A. Richards, and John S. Flynt to receive one share to be equally divided between them, my son William to receive one share, my daughter Martha, one share and my daughter Harriet one share. Item 7th – I will that all the remainder and what ever it may be to be sold and the proceeds together with any remaining money (if any) notes and accounts to be divided among the legatees mentioned in the last Item and in the same proportion. Item 8th – In the event that my Infant daughter dies without a living issue I wish all the property which I have willed to her be divided between the remaining legatees their heirs & assigns as mentioned in the sixth item and in the same proportion, that is my wife Amanda shall receive one sixth, my daughter Susan one sixth, my daughter Martha one sixth, my Daughter Harriet one sixth, my son William one sixth and my Grand Children Sarah A. Richards, and John S. Flynt to receive the remaining sixth to be divided equally between them. Item 9th – I hereby constitute and APPOINT MY SON WILLIAM A. OVERTON THE EXECUTOR of this my last will and testament and I wish him to execute it in full in all directions and purposes. – In witness whereof I have hereunto set my hand and affixed my Seal this Nineteenth of September one Thousand eight hundred and Sixty.
