I CHARLES BEAZLEY of the State of Georgia and County of Taliaferro, being of sound mind and disposing memory and in usual bodily health but knowing the great uncertainty of life and being desireous of having all proper and necessary arrangements made for the disposal of my property in case of death do now touching all the worldly effects whereof I may die possessed make declare and publish this my last will & testament, herby revoking canceling and annulling all and every other will or wills heretofore made by me – Item 1st. It is my will and desire that all my just debts and funeral expenses be first paid by my Executor out of my estate. Item Second - All the balance of my property which under the blessing of God I may have at my death I wish divided between MY BELOVED WIFE CATHERINE BEAZLEY and all my Children upon the principals of justice and equity and so that there may be no hard feelings between any of them. And for this object and purpose in as much as MY PRESENT WIFES FATHER MR. JOHN STEWART OF VA now deceased gave me Six Hundred dollars for her with this I bought land and afterwards I received from his estate the amount of Three Thousand dollars which he by will though informally made and executed wished secured to her and her children and in as much as it is my desire that his will and wish in this particular shall be complied with, by me, it is therefore my will & desire that my property after the payment of my debts &c shall be divided between my beloved present wife Catherine & all my children as well – those I have by her as the four by my former wife in the following manner – this is to say – I wish her first to select out of my estate thirty six hundred dollars worth of property to be taken at the value put upon it by the lawful appraisers to be appointed by the Court to appraise the property of my estate – this thirty six hundred dollars worth of property to consist of land or negroes, both or anything else she may select – I give to her absolutely to do as she pleases with it, and I wish it taken out of my estate and set apart for her – and then all the balance of my property that may be left of whatever kind it may be I wish divided into twelve equal parts – One of these I likewise give to my said beloved wife Catherine – and one to each of my four beloved children by my first wife, to wit WILLIAM A., BEAZLEY, WALTER A. BEAZLEY, EDMUND N. BEAZLEY & CHARLES A. BEAZLEY and one of these twelve equal parts or shares I also give to each of my beloved children by my present wife, to wit, MARY F. E. OVERTON, JOHN S. BEAZLEY, FREDERICK A. BEAZLEY, ARTHUR G. BEAZLEY, JULIA C. BEAZLEY, ISABELLA H. BEAZLEY & EMMA J. BEAZLEY. Item Third – In case any of my said beloved children shall depart this life before I do leaving a child or children living then it is my wish that such child or children of such one or more of my deceased children shall stand in the place of the deceased parent. Item Fourth – I nominate appoint and constitute my beloved son William A. Beazley by my first wife and my beloved son John S. Beazley by my present wife joint Executors to this my last will & testament and do hope they will jointly act and as affectionate Sons see that the will in all its parts and objects is faithfully and truly carried out – In testimony whereof I have hereto set my hand and seal this twenty first day of April 1856. /s/ Chas. Beazley I give to his children instead of himself and the like portion for my son Edmund N. Beazley I give to his children instead of to him – It is my will & wish that my Son Walter A. Beazley have five hundred & (469)?? Sixty nine Dollars less of my estate than the other distributees respectively as I paid that amount security debt for him in the case of Bullock against him and me his security. Stephens Singleton Harris Quinea O’Neal ADDITIONAL CODICIL TO MY LAST WILL & TESTMENT Whereas I Charles Beazley of the State of Georgia and County of Taliaferro did heretofore, to wit, on the twenty first day of April 1856 make and execute my last Will and testament in the presence of Alexander H. Stephens, John M. Tilly & William H. Wilder the witnesses thereto and afterwards to wit on the 26th October 1857, did make a Codicil thereto in the presence of said Alexander H. Stephens, Singleton Harris & Quinea O’Neal witnesses thereunto, and whereas since then one of my said children in said will named, to wit, Isabella H. Beazley has departed this life without having any [next line unreadable due to bad spot in film] my said will and make this modification of the same, to wit, that it is my will and desire that the portion mentioned for my said daughter Isabella H. Beazley be divided between all the other legatees named in the second item of my said will equally – that is to say the balance of my property as provided in said second item of my will is to be divided into eleven portions or shares instead of twelve and in case of the death of any other of my said Children before my death leaving no child or issue living at the time of my death then the portion of such child is to be equally divided between the survivors of said legatees in said second item of my will - whatever amounts any of my said Sons shall owe me by note or other wise at my death I wish to be considered as an advancement by me to them and on the division they are each of them to account for the sum as is provided in the first Codicil to my will in the case of my son Walter A. Beazley. – In all other particulars I hereby reaffirm and republish my said will and the other Codicil thereto as above mentioned and do declare the whole with this additional codicil to be my last will and testament. In testimony whereof I have hereto set my hand and seal this 19th September 1860. /s/ Chas. Alexander H. Stephens John A. Stephens George F. Bristow Georgia Taliaferro County – Personally appeared before me in the Ordinarys office in the said County Alexander H. Stephens who after being duly sworn upon oath saith that he saw Charles Beazley sign & seal the within papers as a codicil to his will and then and there declare and publish it as a part of his last will & testament therein affirming the other papers hereto attached as his last will & testament – that said Charles Beazley was at the time of sound mind & disposing memory that the deponent signed said instrument as a witness thereto at his request and he saw the other witnesses sign the same as witness in the presence of the testator and in the presence of each other. – /s/ Alexander H. Stephens Sworn to and subscribed before me this 24th Jany 1863 - Quinea O’Neal Ordinary Georgia Taliaferro County – Personally appeared before me in the Ordinarys office in and for said County George W. Bristow who after being duly sworn upon oath saith that he saw Charles Beazley sign seal and publish the additional codicil to testators will dated 19th day of December 1860, that he was of sound and disposing mind and memory that he did it freely without compulsion that he saw John A. Stephens and Alexander H. Stephens sign the same as witnesses with himself and in the presence of testator and at his special request and in presence of said others – /s/ George W.
